To the seasoned trial advocate, at first blush, this case appeared to be an open and shut case for the prosecution, where the wife was standing at the threshold of the bedroom door with a rifle, while the husband was seated on the bed five feet distance from her and demonstrating a downward trajectory of the bullet on the inside of the husband’s body. He had been threatening to kill the family and then commit suicide. The forensic team for the prosecution focused only on the downward trajectory of the bullet on the inside of the decedent’s body and did not believe the wife’s story that he was on his feet charging her, reaching for the rifle, when the shot was fired, thus never considered a primary trajectory that supported the defendant's version of the facts.
